Online poker is legal in California… my mother uses PartyPoker.com quite frequently, and puts down real money doing it.
I think they circumvent the law by saying that your money purchases a certain number of "credits" and that you can, at any point, cash out your "credits."

Technically, it's probably illegal, but not something that will be enforced.
